Terms of Service

These Terms of Service ("Terms") govern your use of Plow, operated by The Plow Collective, Inc ("Plow Co", "we", "our", or "us"), including our macOS application, SMS text messaging service, web services, and API (collectively, the "Service"). By using Plow, you agree to these Terms.

1. Eligibility

You must be at least 13 years old to use Plow. By using the Service, you represent that you meet this requirement.

2. Your Account

You are responsible for maintaining the security of your account credentials, API keys, and session tokens. You are responsible for all activity that occurs under your account. Notify us immediately if you suspect unauthorized access.

3. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws.
• Attempt to gain unauthorized access to the Service or its related systems.
• Reverse engineer, decompile, or disassemble any part of the Service.
• Use the Service to harm, harass, or infringe on the rights of others.
• Interfere with or disrupt the Service or servers connected to it.
• Use the Service to generate spam, phishing, or other abusive content.

4. Your Data

You retain ownership of all data you provide to or access through Plow. By using the Service, you grant us a limited license to process your data solely to provide and improve the Service. See our Privacy Policy for details on how we handle your data.

5. AI-Generated Content

Plow uses artificial intelligence to process your requests and generate responses. AI outputs may be inaccurate, incomplete, or inappropriate. You are responsible for reviewing and verifying any AI-generated content before relying on it. Plow is not a substitute for professional advice (medical, legal, financial, or otherwise).

6. Third-Party Services

Plow connects to third-party services (email providers, calendars, AI providers, etc.) at your direction. Your use of these services is subject to their respective terms and policies. We are not responsible for the availability, accuracy, or practices of third-party services.

7. Intellectual Property

The Service, including its design, code, and branding, is owned by Plow and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or other brand features.

8. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or if we need to do so for legal, security, or operational reasons. Upon termination, your right to use the Service ceases immediately.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.

10. Limitation of Liability

To the maximum extent permitted by law, Plow shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising out of or related to your use of the Service, regardless of the theory of liability.

11. Indemnification

You agree to indemnify and hold harmless Plow and its officers, employees, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

12. Governing Law

These Terms are governed by the laws of the State of Washington, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in King County, Washington.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes through the app or by email. Continued use after changes constitutes acceptance of the updated Terms.

14. SMS/Text Messaging Terms

Plow Co offers an SMS text messaging service (the "Messaging Service") that allows you to communicate with the Plow application via text message. Messages may include AI-generated responses to your requests, such as weather forecasts, calendar summaries, email digests, web search results, and other informational content.

Opt-in and consent. By checking the SMS consent checkbox during onboarding and sending the activation code to our number, you consent to receive recurring automated text messages from Plow Co at the mobile number you provide. Consent to receive text messages is not a condition of purchasing or using the Plow application.

Message frequency. Message frequency varies based on your usage of the Service. The system sends messages only in response to your inbound text messages and does not send unsolicited outbound messages.

Message and data rates. Message and data rates may apply. Contact your wireless carrier for details about your messaging plan.

Opt-out. You can opt out of the Messaging Service at any time by replying STOP to any message. After opting out, you will receive a final confirmation message and no further messages will be sent. You may re-subscribe at any time by re-activating through the Plow application.

Help. For help with the Messaging Service, reply HELP to any message or contact us at support@plow.co.

Supported carriers. The Messaging Service is available on major US wireless carriers. Plow Co and wireless carriers are not liable for delayed or undelivered messages.

Privacy. Your phone number and messaging data are handled in accordance with our Privacy Policy.
